A rightful instruction by your employer is a mandate, basis on which you may be disciplined if not properly followed. But can you be fired if you express your view on your employer’s instruction without actually breaching it? Here’s an interesting ERA case that says you may be justifiably dismissed. If so, you may be liable for your employer’s legal costs too, as happened in this case.
It will be interesting to see how the Employment Court will review this decision.
